Our fees for services will be agreed upon in writing before commencement of work. Payment terms are typically 30 days from invoice date unless otherwise specified. Late payment may result in interest charges and suspension of services. All prices are quoted in Euros and include applicable VAT where required.
All content, materials, and information provided by nimbusharvester, including but not limited to text, graphics, logos, images, and software, are the property of nimbusharvester or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
We respect the confidential nature of your personal and property information. We will not disclose confidential information to third parties without your consent, except as required by law or necessary to provide our services. This obligation continues after the termination of our services.
To the fullest extent permitted by law, nimbusharvester shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services. Our total liability shall not exceed the amount of fees paid by you for the specific service giving rise to the claim.
We conduct our business in accordance with applicable professional standards and regulations governing real estate services in the Netherlands. However, we cannot guarantee specific outcomes or results from our services, as property transactions involve various factors beyond our control.
These terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the Dutch courts. The parties agree to attempt to resolve any disputes through good faith negotiation before pursuing legal action.
Either party may terminate our services agreement with reasonable written notice. Upon termination, you remain liable for all fees and charges incurred up to the termination date. Termination does not affect any rights or obligations that have accrued prior to termination. Certain provisions of these terms shall survive termination, including confidentiality, intellectual property, and limitation of liability clauses.
We shall not be liable for any failure or delay in performance under these terms which is due to fire, flood, earthquake, pandemic, governmental action, war, terrorism, or other causes beyond our reasonable control.
We reserve the right to modify these terms at any time. We will notify clients of material changes via email or website notice. Continued use of our services after such modifications constitutes acceptance of the updated terms.
If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remainder of these terms shall remain in full force and effect.
